
Every day, Colorado Legal Services‘ attorneys across Colorado help families stay safe, seniors remain housed, survivors escape abuse, veterans secure benefits, and children access the care they need. Through the Legal Aid Foundation’s Law Firm Campaign, Colorado law firms make that work possible. A leadership contribution of $475 per Colorado attorney can make a meaningful impact in sustaining civil legal aid across Colorado, helping Colorado Legal Services support families like Raya Bernal’s.
Raya’s child needs an adaptive car seat, a specialized car seat tailored to fit his medical needs, which was recommended by his doctors to ensure his safety while traveling. But despite the medical necessity, Medicaid denied their request for coverage, leaving Raya to navigate an impossible choice between safety and taking her child to doctor’s appointments and elsewhere without medically necessary safety precautions.
Across Colorado, families of children with disabilities faced similar Medicaid coverage denials, even when adaptive car seats were essential for their children’s well-being. With support from Colorado Legal Services, Raya and other families pushed back. Attorneys worked alongside them to challenge repeated Medicaid denials and advocate for their right to keep their children safe on Colorado roads.
Although the Colorado Department of Health Care Policy and Financing told Colorado news outlet Denver7 that it has changed its practice, Colorado Legal Services is still seeing denials for adaptive car seats. It shouldn’t take an often months- or years-long legal battle for a child to have what they need, but attorneys at CLS continue to help as many families as they can.
